46.2-2099.6. When certificate granted.

The public convenience and necessity to be served by this article is toencourage passengers to visit points of interest in Virginia by providingeconomical, comfortable and convenient transportation, and, in the issuanceof certificates, the Department shall consider all facts bearing on thatpurpose, including provisions of 46.2-2011 and existing means oftransportation. The Department shall issue no more certificates than thepublic convenience and necessity require, and shall place such restrictionsupon such certificates as may be reasonably necessary to protect any existingcommon carrier regulated pursuant to Article 6 of this chapter operating overthe same route or routes under a certificate issued by the Department, but itshall not deny a certificate solely on the ground that the applicant willoperate over the route or part of the route of an existing common carrierregulated pursuant to Article 6 of this chapter.
