38.2-603. Pretext interviews.

No insurance institution, agent, or insurance-support organization shall useor authorize the use of pretext interviews to obtain information inconnection with an insurance transaction. However, a pretext interview may beundertaken to obtain information from a person or institution that does nothave a generally or statutorily recognized privileged relationship with theperson about whom the information relates for the purpose of investigating aclaim where, based upon specific information available for review by theCommission, there is a reasonable basis for suspecting criminal activity,fraud, material misrepresentation, or material nondisclosure in connectionwith the claim.
