32.1-126.1. Asbestos inspection for hospitals.

The Commissioner shall not issue a license to or renew the license of anyhospital which is located in a building built prior to 1978 until he receivesa written statement that either (i) the hospital has been inspected forasbestos in accordance with standards in effect at the time of inspection; or(ii) that asbestos inspection will be conducted within twelve months ofissuance or renewal, in accordance with the standards established pursuant to 2.2-1164 in the case of state-owned buildings or 36-99.7 in the case ofall other buildings; and (iii) that response actions have been or will beundertaken in accordance with applicable standards. Any asbestos managementprogram or response action undertaken by a hospital shall comply with thestandards promulgated pursuant to 2.2-1164 in the case of state-ownedbuildings or 36-99.7 in the case of all others.

The Commissioner may amend the standards for inspections, management programsand response actions for hospitals subject to this section, in accordancewith the requirements of the Virginia Administrative Process Act ( 2.2-4000et seq.).

The provisions of Article 1.1 ( 32.1-102.1 et seq.) of Chapter 4 of thistitle shall not apply to expenditures made by hospitals pursuant to theprovisions of this section.
