5.1-40. Lease of land acquired; approval by Department.

Any city, town or county acquiring land under the provisions of this articlemay individually, or jointly where so operated, lease the same, or any partthereof, to any individual or corporation desiring to use the same for thepurpose of operating an airport or landing field, or for the purpose oflanding or starting airplanes therefrom or for other aviation purposes, andon such terms and subject to such conditions and regulations as may beprovided; and any city, town or county may enter into a contract in the formof a lease providing for the use of such land, or any part thereof, by thegovernment of the United States for the use by the government of such landfor aviation, mail delivery or other aviation purposes upon nominal or otherrental or without consideration; provided that such lease to an individual ora corporation or to the government of the United States shall not be of anyforce, effect or validity until the same shall be approved by the Department.
