3.1-392. Duty of attorney for the Commonwealth when violation reported;notice before such report.

It shall be the duty of each attorney for the Commonwealth, to whom theCommissioner reports any violation of this article, to cause appropriateproceedings to be instituted in the proper courts without delay and to beprosecuted in the manner required by law. Before any violation of thisarticle is reported to any such attorney for the institution of a criminalproceeding, the person against whom such proceeding is contemplated shall begiven appropriate notice and an opportunity to present his views before theCommissioner or his designated agent, either orally or in writing, in personor by attorney, with regard to such contemplated proceeding.
