§ 1664. Encumbered property; disposition of surplus

After payment of the debts secured, the surplus of such sale shall be administered by the executor or administrator as such property would be if it were not held as security. A certificate of such sale, filed by the executor or administrator in the office of the clerk where by law a deed of such property is required to be recorded, shall operate as a discharge of such mortgage or lien.
