CHAPTER 33. OSTEOPATHY

Subchapter I. General Provisions

§ 1753. Exemptions

(a) The provisions of subdivision 1752(a)(1) of this title, relating to practice, shall not apply to the following persons acting within the scope of their respective practices:

(1) A person licensed to practice medicine and surgery under chapter 23 of this title.

(2) A person licensed to practice chiropractic medicine under chapter 9 of this title.

(3) A physician's assistant certified or registered pursuant to chapter 31 of this title.

(b) The provisions of subdivision 1752(a)(1) of this title shall not apply to any person or persons giving aid, assistance or relief in emergency or accident cases pending the arrival of a licensed physician or surgeon.

(c) The provisions of this chapter shall not apply to:

(1) A commissioned officer of the United States Armed Forces or public health service when acting within the scope of his or her official duties.

(2) A nonresident licensed osteopathic physician or surgeon who is called to treat or to consult on a particular case in this state provided he or she does not otherwise practice in this state. (Added 1989, No. 253 (Adj. Sess.), { 4.)
