33A-3-7. Criminal offenders not subject to transfer--Exception--Transfer deemed to be original commitment. No person may be transferred to the United States Department of Veterans' Affairs or other agency of the United States if the person is confined pursuant to conviction of any felony or misdemeanor or if the person has been acquitted of the charge solely on the ground of mental illness, unless prior to transfer the court or other authority originally committing the person enters an order for the transfer after appropriate motion and hearing.

Any person transferred as provided in §§ 33A-3-2 to 33A-3-7, inclusive, is deemed to be committed to the United States Department of Veterans' Affairs or other agency of the United States pursuant to the original commitment.
