AN ACT

 

Amending the act of June 2, 1915 (P.L.736, No.338), entitled "An act defining the liability of an employer to pay damages for injuries received by an employe in the course of employment; establishing an elective schedule of compensation; providing procedure for the determination of liability and compensation thereunder; and prescribing penalties," in health and safety, further providing for certification of safety committee.

 

The General Assembly of the Commonwealth of Pennsylvania hereby enacts as follows:

 

Section 1.  Section 1002(a) of the act of June 2, 1915 (P.L.736, No.338), known as the Workers' Compensation Act, is amended and the section is amended by adding a subsection to read:

Section 1002.  (a)  An insured employer may make application to the department for the certification of any established safety committee operative within its workplace developed for the purpose of hazard detection [and], accident prevention and providing information regarding the risks associated with substance abuse, including opioid painkiller use. The department shall develop such certification criteria.

(a.1)  Within twenty-one (21) days, the department shall notify, develop and make available resources for employers to comply with this section.

Section 2.  This act shall take effect as follows:

(1)  The following shall take effect immediately:

(i)  The addition of subsection (a.1) of the act.

(ii)  This section.

(2)  The remainder of this act shall take effect in 120 days.
