Section 743.965 - Incorrect payments; right to hearing.

(1) If the Department of Consumer and Business Services determines that the assessment paid by the insurer under ORS 743.961 is incorrect, the department shall charge or credit to the insurer the difference between the correct amount of the assessment and the amount paid by the insurer.
(2) An insurer that is aggrieved by an action of the department taken pursuant to subsection (1) of this section shall be entitled to notice and an opportunity for a contested case hearing under ORS chapter 183. [2009 c.867 §7]
