NRS 442.016 - Limitations on charge to third party.

Universal Citation: NV Rev Stat § 442.016 (2022)

1. A physician or other person permitted by law to attend upon a pregnant woman during gestation for conditions relating to her pregnancy shall not require a third party to pay more for any examination or test required by NRS 442.010 or 442.013 than the lowest rate prescribed in a contract between the third party and a provider of the same type as the physician or other person for the same test or treatment.

2. A laboratory shall not require a third party to pay more for any test required by NRS 442.010 or 442.013 than the lowest rate prescribed in a contract between the third party and a laboratory for the same test.

3. A hospital or other facility at which a sample is taken for the purpose of performing a test required by NRS 442.010 or 442.013 shall not require a third party to pay more for the test than the cost incurred by the hospital or other facility to process the sample, including, without limitation, the cost of sending the sample to a laboratory.

4. As used in this section, "third party" means:

(a) An insurer, as that term is defined in NRS 679B.540;

(b) A health benefit plan, as that term is defined in NRS 687B.470, for employees which provides coverage for prescription drugs;

(c) A participating public agency, as that term is defined in NRS 287.04052, and any other local governmental agency of the State of Nevada which provides a system of health insurance for the benefit of its officers and employees, and the dependents of officers and employees, pursuant to chapter 287 of NRS; or

(d) Any other insurer or organization that provides health coverage or benefits in accordance with state or federal law.
