NRS 389.0115 - Administration of examinations to pupils with disabilities; modifications and accommodations required for certain pupils; State Board required to prescribe alternate examination.

NV Rev Stat § 389.0115 (2014) What's This?

1. If a pupil with a disability is unable to take an examination administered pursuant to NRS 389.550 or 389.805 under regular testing conditions, the pupil may take the examination with modifications and accommodations that the pupil s individualized education program team determines, in consultation with the Department and in accordance with the Individuals with Disabilities Education Act, 20 U.S.C. 1400 et § 2001, 20 U.S.C. 6301 et § 2. The State Board shall prescribe an alternate examination for administration to a pupil with a disability if the pupil s individualized education program team determines, in consultation with the Department, that the pupil cannot participate in all or a portion of an examination administered pursuant to NRS 389.550 or 389.805 even with modifications and accommodations.

3. The State Board shall prescribe, in accordance with the Individuals with Disabilities Education Act, 20 U.S.C. 1400 et § 2001, 20 U.S.C. 6301 et § 4. As used in this section:

(a) Individualized education program has the meaning ascribed to it in 20 U.S.C. 1414(d)(1)(A).

(b) Individualized education program team has the meaning ascribed to it in 20 U.S.C. 1414(d)(1)(B).
