50-73-410. Department inspection upon advisement of accident, injury, or fatality. (1) When advised by an operator of any accident in a coal mine involving loss of life or serious personal injury, the department shall, if it considers it necessary from the facts reported and in all cases of loss of life, immediately have an inspector go to the scene of the accident within 48 hours of notification. (2) The department may also make any original or supplementary investigation that it considers necessary as to the nature and cause of an accident and shall make a record of the circumstances and of the result of the investigations for its files. (3) The inspection team must include a department coal mine inspector, the employer or the employer's designee, and a representative of the employees.
