Section 37. In cases brought under the preceding section the petition, if brought on account of a trust under a will, shall be brought in the probate court for the county where the trustee was appointed, and, if brought on account of a trust under a written instrument other than a will, shall be brought in the probate court of any county where any of the parties interested in the trust reside or where any of the land held in trust is situated. If any probate court has assumed jurisdiction of the trust, the petition shall be brought in that court.
