§ 15-402 - Unauthorized use of title

§15-402.

(a) Except as otherwise provided under this title, a person may not represent or imply to the public by use of the title “licensed physician assistant”, by other title, or by description of services, methods, or procedures that the person is licensed to practice as a physician assistant in the State.

(b) Unless licensed to practice as a physician assistant under this title, a person may not use the words or terms “physician assistant”, “licensed physician assistant”, or “P.A.”.

§ 15-402 - 1. Employment or supervision of unlicensed physician assistant

(a) Prohibition -- Licensed physician. -- Except as otherwise provided in this subtitle, a licensed physician may not employ or supervise an individual practicing as a physician assistant who does not have a license.

(b) Prohibition -- Hospital, related institution, alternative health care system, employer. -- Except as otherwise provided in this subtitle, a hospital, related institution, alternative health care system, or employer may not employ an individual practicing as a physician assistant who does not have a license.

(c) Civil penalty. -- The Board may impose a civil penalty in an amount not exceeding $ 1,000 for a violation of this section.

(d) Remittance of penalty into Fund. -- The Board shall remit any penalty collected under this subsection into the Board of Physicians Fund.
