§4577. Beauregard Parish Covered Arena Authority; creation; jurisdiction; purposes; board; powers

A. The Beauregard Parish Covered Arena Authority, hereinafter referred to as the "authority," is hereby created. The purpose of said authority shall be to build, operate, and maintain a covered arena facility within the boundaries of Beauregard Parish.

B.(1) The authority shall initially consist of nine members as follows:

(a) The president of the Beauregard Parish Police Jury.

(b) The mayor of the city of DeRidder.

(c) The mayor of the town of Merryville.

(d) The president of the Beauregard Parish Riding Club.

(e) One representative of the Beauregard Parish Fair Board.

(f) The members of the legislature representing Beauregard Parish.

(2) The initial board of commissioners shall determine the planning, acquisition, and construction of the facility and shall have the following powers and duties:

(a) To enter into contracts for the sale, lease, or exchange of property of or for the authority.

(b) To enter into cooperative endeavors with any special district, political subdivision, or local governmental unit of the state.

(c) To accept donations of money or property to accomplish the authority's purposes from public or private sources.

(d) To do any and all things necessary to carry out the purposes of the authority.

(3) The terms of the initial members shall expire upon the substantial completion of the facility.

C.(1) Upon the expiration of the terms of the initial members appointed pursuant to Subsection B of this Section, the authority shall be composed of five members to be appointed as follows:

(a) The president of the Beauregard Parish Police Jury.

(b) Four members appointed by the members of the legislature representing Beauregard Parish. Two of the appointments made pursuant to this Subparagraph may be a representative of the Beauregard Parish Riding Club and a representative of the Beauregard Parish Rodeo Club.

(2) The president of the Beauregard Parish Police Jury shall serve a term concurrent with that of his elected office. The remaining members appointed to succeed the initial members shall serve at the pleasure of the respective appointing authority. Such members shall operate and maintain the covered arena facility after the facility is substantially complete and shall have the following powers and duties:

(a) To enter into contracts for the sale, lease, or exchange of property of or for the authority.

(b) To enter into cooperative endeavors with any special district, political subdivision, or local governmental unit of the state.

(c) To accept donations of money or property to accomplish the authority's purposes from public or private sources.

(d) To fix, maintain, collect, and revise rates, charges, and rentals for the use of authority facilities and services.

(e) To repair, maintain, and operate authority facilities.

(f) To contract with any public or private entities for the maintenance and operation of property owned or operated by the authority.

(g) To borrow money to pay its obligations and to accomplish the authority's purpose.

(h) To do any and all things necessary to carry out the purposes of the authority.

D. The members of the authority shall serve without compensation. If any appointing authority disbands or otherwise ceases to exist, the legislative delegation shall appoint a member to fill such vacancy. A vacancy in the membership of the authority shall be filled in the same manner as the original appointment.

E. The authority shall elect from its membership a chairman and may elect other officers as deemed necessary for the efficient operation of the affairs of the authority. The chairman of the authority shall give seven days notice to the members of the authority as to the time and place where regular or special meetings will be held.

F. The governing authority of Beauregard Parish shall receive the approval of a majority of the authority prior to the expenditure of any funds for the facility.

G. Upon the expiration of the terms of the initial members, all records and information shall be released to the successors.

H. Notwithstanding any provision of law to the contrary, a member of the board may serve as the executive director or manager of the Beauregard Parish Covered Arena and be compensated for duties performed in such capacity for not more than twenty hours per week. Any member who serves as the executive director or manager shall recuse himself from any decision involving his promotion, discipline, or discharge.
