RS 27:97 — Declaratory judgments
§97. Declaratory judgments
A. The division or the commission may obtain a judicial determination of any question of construction or validity of a provision of this Chapter or any rule or regulation of the division or commission by bringing an action for a declaratory judgment in the Nineteenth Judicial District Court in accordance with the provisions of the Louisiana Code of Civil Procedure.
B. When an appeal is brought by a person other than the division, the division shall be made a party to the action.
C. Statutes and rules and regulations reviewed pursuant to this Section must be construed in a manner consistent with the declared policy of the state.
D. The filing of a petition for judicial determination under this Section shall not stay enforcement of any division or commission action. The division or the commission may grant a stay upon appropriate terms.
E. The district court shall give priority over other civil actions to an action brought pursuant to this Section.
