Download as PDF 69.008 Commonwealth's and county attorneys prohibited from requesting or requiring victim of alleged sexual offense to submit to polygraph or other examination -- Other prohibitions. No Commonwealth's or county attorney shall: (1) As a condition of proceeding with an investigation or prosecution of a case, request or require a victim of an alleged sexual offense to submit to a polygraph examination or any other device designed for the purpose of determining whether a person is telling the truth; or (2) Charge or threaten to charge the victim of an alleged sexual offense with prosecution for a criminal offense for refusing to submit to a polygraph examination or other device designed for the purpose of determining whether a person is telling the truth. Effective: July 15, 2008 History: Created 2008 Ky. Acts ch. 112, sec. 2, effective July 15, 2008. Legislative Research Commission Note (7/15/2008). 2008 Ky. Acts ch. 112, sec. 2, provided that this statute be created as a new section of KRS Chapter 65. However, in codification the Reviser of Statutes has created it as a new section of KRS Chapter 69, relating to Commonwealth's and county attorneys, under the authority of KRS 7.136(a).
