(1) (2) The fiscal court of any county, or any urban-county government, may acquire by purchase or lease or lease-purchase agreement or abandon any voting system covered by this chapter, if the equipment has been approved by the State Board of Elections. The fiscal court shall notify the State Board of Elections that a new voting system is being installed in the county. The county clerk of any county may petition the State Board of Elections to allow a new voting system in the county if an emergency exists. The petition must state the reasons why the present equipment is inadequate. Within sixty (60) days of the receipt of the petition the State Board of Elections shall notify the county clerk whether the permission to obtain a new voting system is granted or denied. The letter of approval shall be presented to the fiscal court for its approval before any new voting system is acquired. Effective: July 13, 1990 History: Amended 1990 Ky.
