(1) (2) For purposes of subsection (2) of this section, any person engaged in the practice of cosmetology or nail technology who leases or rents space at a respective beauty salon or nail salon from the holder of a license to operate the beauty salon or nail salon shall be deemed an independent contractor. The board shall not hold the holder of a license to operate a beauty salon or nail salon responsible for violations of this chapter, or administrative regulations promulgated pursuant to this chapter, that are committed by an independent contractor.
