Prior to the effective date of a new administrative regulation, or an amended administrative regulation that has been filed with the Legislative Research Commission, an administrative body shall not file subsequent amendments to that administrative regulation unless: (1) Failure to do so would result in a loss of accreditation, or federal or state funds, or the imposition of another state or federal penalty; or (2) A court decision, or a federal or state mandate requires immediate implementation of the amendment; or (3) Conditions warrant the filing of an emergency administrative regulation; or (4) The amendments are made: (a) After a public hearing or public comment period as provided by KRS 13A.280; or (b) At a subcommittee meeting during which the administrative regulation is reviewed as provided by KRS 13A.290.
