35.095 Jurisdiction of summary courts-martial.

(1) (2) (3) Summary courts-martial shall have jurisdiction to try subject persons, except officers, for any offense for which they may be punished by this code. No person shall be tried by a summary court-martial if, prior to trial, he objects thereto. If objection to trial by summary court-martial is made by such an accused, trial may be ordered by special or general court-martial as is appropriate. A summary court-martial shall have the power to impose the following punishments: (a) Confinement not exceeding twenty-five (25) days for a single offense; (b) Fines or forfeitures of pay and allowances not to exceed twenty-five dollars ($25) for a single offense; (c) Reduction of enlisted personnel in the pay grade of E-4 and below to the lowest enlisted grade; or (d) A combination of these punishments.
