35.040 Apprehension of deserters.

It shall be lawful for any civil officer having authority to apprehend offenders under the laws of the United States or of any state, district, territory or possession of the United States, summarily to apprehend a deserter from the National Guard or active militia and deliver him into the custody of the National Guard or active militia. If an offender is apprehended outside the state, his return to the area must be in accordance with normal extradition procedures, or reciprocal agreements. History: Amended 1970 Ky. Acts ch. 56, sec. 6. -- Created 1954 Ky. Acts ch. 99, sec. 7, effective July 1, 1954.
