The racing commission may require the production of reports or the surrender of sums represented by unclaimed pari-mutuel tickets as provided in KRS 230.361 to 230.373 by civil equity action, including, but not limited to, an action in the nature of a bill of discovery, in which case the defendant shall pay a penalty equal to ten percent (10%) of all amounts that he is ultimately required to surrender. The racing commission shall follow the procedures provided by the Rules of Civil Procedure. Effective: July 15, 2010 History: Amended 2010 Ky.
