It is the intent of the General Assembly, when funds are available, that the
University of Kentucky update the study completed in July 1995, and recommend
amendments to standards for levels of petroleum contamination, including lead and
other additives, requiring corrective action to adequately protect human health,
safety, and the environment established in administrative regulations promulgated
by the cabinet, based on new information or changes in federal law.
The division shall contract with the University of Kentucky when funds are
available.
The cabinet shall, by administrative regulation, adopt standards for corrective action
for a release into the environment from a petroleum storage tank. The
administrative regulations shall adequately protect human health, safety, and the
environment, and may consider the study and any revisions or amendments to it
performed for the division, except as necessary to comply with federal law.
Within ninety (90) days of July 15, 2002, the cabinet shall develop an inventory of
facilities eligible for reimbursement from the financial responsibility account and
the petroleum storage tank account and information on the current status of each
facility within the corrective action process. The cabinet shall update the inventory
and the status of the facilities and submit the information quarterly to the
Legislative Research Commission.
