No caller or merchant making or causing to be made a telephone solicitation shall request <br>or accept payment from a consumer or make or submit any charge to the consumer's <br>credit or bank account until either: <br>(1) The merchant receives from the consumer a signed copy of a written contract complying with KRS 367.46961(4); or (2) The cancellation period provided in KRS 367.46961(1) has expired, and the consumer has not exercised his right to cancel. Effective: July 15, 1994 <br>History: Created 1994 Ky. Acts ch. 302, sec. 5, effective July 15, 1994; and ch. 463, sec. 5, effective July 15, 1994. Legislative Research Commission Note (7/15/94). This statute was created by 1994 Ky. Acts chs. 302 and 463, which are substantively identical and have been codified <br>together. Minor variations have been resolved by giving precedence to Acts ch. 463 <br>which was enacted last.
