Section 47-666  Killing animals affected with vesicular exanthema; right of indemnity.

47-666. Killing animals affected with vesicular exanthema; right of indemnity. Whenever the animal health commissioner has decided that any swine is affected with vesicular exanthema and that it is necessary to order the animals killed in order to prevent the spread of such disease in Kansas, the animal health commissioner shall proceed with the appraisement, condemnation and killing of such swine as authorized under K.S.A. 47-614 and 47-615, and amendments thereto. The owner of such diseased animals which have been so killed and disposed of shall be entitled to receive from the state of Kansas 1/3 of the difference between the appraised value of the animals and the salvage proceeds, if any, received by the owner from the destruction and disposal of such animals.

The animal health commissioner shall draw a voucher upon the director of accounts and reports of the state of Kansas in favor of the owner of such diseased animals for the amount of indemnity for which such owner is entitled, and the director of accounts and reports is hereby authorized and directed to accept such vouchers so drawn by the state animal health commissioner, such amounts to be paid for out of the funds appropriated for such purposes.
