47-653d. Hog cholera; destruction of swine; appraisal of animals. In order to prevent the spread of hog cholera and to reduce the danger of the spread thereof, the animal health commissioner, or the authorized representative of the animal health commissioner, may destroy or require the destruction of any swine which the animal health commissioner has determined to be affected with or exposed to hog cholera. Prior to such destruction there shall be an appraisal of the value of any swine, which shall be made jointly by the owner of such swine and the animal health commissioner, or the authorized representative of the animal health commissioner. If the appraisers cannot agree, a disinterested third party who has knowledge of livestock values in such locality shall be selected by the commissioner and the owner, at the expense of the owner, as an arbitrator. The arbitrator's determination of the value of such swine shall be final.
