PERRY II, CLERK SUPREME COURT OF APPEALS OF WEST VIRGINIA I concur in the result of the majority opinion and its reasoning. However, I do not agree with setting out detailed FOIA procedures in new syllabus points. This Court, too frequently, is accused of legislating. This is an example of where we have unnecessarily developed new law. To me, this task would be better accomplished by the Legislature through rule-making.
