STATE OF VERMONT SUPERIOR COURT Environmental Division Unit ENVIRONMENTAL DIVISION Docket No. 147-10-13 Vtec Killington Village Master Plan Act 250 Application SECOND AMENDED JUDGMENT ORDER Pursuant to the December 29, 2016 Order of the Vermont Supreme Court, based upon the parties’ stipulation to withdraw the appeal pending before the Supreme Court (Supreme Court Docket No. 2016-342) and requesting remand, we do hereby REMAND these proceedings to the District #6 Environmental Commission (“District Commission”), so that the District Commission may complete the ministerial act of issuing a new Act 250 Land Use Permit for the proposed Phase 1 of the Master Plan consistent with this Court’s June 21, 2016 Decision on the Merits, as supplemented by this Court’s August 29, 2016 Entry Order, granting a motion to alter and amend the permit conditions stated in that Merits Decision, and the August 29, 2016 Amended Judgment Order. The Court will mail a courtesy copy of this Second Amended Judgment Order to the District Commission, together with the Merits Decision, Entry Order, and Amended Judgment Order referenced herein. The District Commission should contact the Court Clerk’s office to make the necessary arrangements to retrieve the exhibits admitted during our de novo merits hearing, pursuant to the direction on page 86 of the Merits Decision. This completes the proceedings before this Court and the Supreme Court concerning the pending master plan application.
