Case No. 20041069-CA

F I L E D
(April 21, 2005)

2005 UT App 180

-----

Third District, Salt Lake Department

The Honorable Leon A. Dever

Attorneys: Clayne I. Corey, Sandy, for Appellant

Bruce C. Burt, Salt Lake City, for Appellee

-----

Before Judges Billings, Bench, and Jackson.

PER CURIAM:

This case is before the court on its own motion for summary dismissal for lack of jurisdiction due to the absence of a final, appealable order. Appellant concedes that this court lacks jurisdiction over this appeal because the order from which she appealed is not a final, appealable order. See Utah R. App. P. 3(a), 5.

Accordingly, this appeal is dismissed without prejudice to the timely filing of an appeal from a final order or proper certification pursuant to rule 54(b) of the Utah Rules of Civil Procedure.
