James Scott Wallberg,

Defendant and Appellant.

MEMORANDUM DECISION
(Not For Official Publication)

Case No. 20030798-CA

F I L E D
(April 29, 2004)

2004 UT App 133

-----

Eighth District, Duchesne Department

The Honorable John R. Anderson

Attorneys: Bryan Sidwell, Vernal, for Appellant

Stephen D. Foote, Duchesne, for Appellee

-----

Before Judges Billings, Orme, and Thorne.

PER CURIAM:

Defendant appeals from his conviction of Child Abuse. The State moves for summary reversal, conceding correctly that the trial court committed plain error by instructing the jury that Defendant had the burden of proving self-defense. See State v. Garcia, 2001 UT App 19,¶20, 18 P.3d 1123. Defendant stipulated that the State's motion should be granted.

Accordingly, we reverse Defendant's conviction and remand for a new trial on the Child Abuse charge.
