PER CURIAM:

    This case is before the court on Plaintiff's motion to dismiss for lack of jurisdiction on the basis that Defendant failed to make a timely motion to the trial court to withdraw his guilty plea. See State v. Reyes, 2002 UT 13,¶¶3-4, 40 P.3d 630. Defendant concedes that this court lacks jurisdiction over this appeal.

    Accordingly, Defendant's appeal is dismissed.
