Case No. 20010220-CA
F I L E D
May 24, 2001
2001 UT App 163
-----
Fourth District, American
Fork Department
The Honorable Howard H.
Maetani
Attorneys:
Robert C. Scutt, Orem, Appellant
Pro Se
Brian K. Haws and James
"Tucker" Hansen, American Fork, for Appellee
-----
Before Judges Greenwood, Billings, and Davis.
PER CURIAM:
This matter is before the court on the city's motion for summary disposition.
Appellant entered a plea in abeyance on charges of impersonating an officer, driving without a license, and speeding. The city correctly argues that a plea in abeyance is not a final judgment. See State v. Hunsaker, 933 P.2d 415, 416 (Utah Ct. App. 1997). In the absence of a final judgment, we have no jurisdiction over the appeal. See Utah R. App. P. 3(a).
Accordingly, the appeal is
dismissed.
