Laura Fisher,
Defendant and Appellant.

MEMORANDUM DECISION
(Not For Official Publication)

Case No. 20010080-CA

F I L E D
November 1, 2001 2001 UT App 325 -----

Fourth District, Orem Department
The Honorable John C. Backlund

Attorneys:
Dana M. Facemyer, Provo, for Appellant
Robert J. Church, Orem, for Appellee -----

Before Judges Greenwood, Jackson, and Bench.

PER CURIAM:

This matter is before the court on a sua sponte motion for summary disposition to affirm the order below "on the basis that the grounds for review are so insubstantial as not to merit further consideration by the appellate court." Utah R. App. P. 10(a)(2).

In response, appellant has not addressed the insubstantial grounds referred to in the motion, but has simply resubmitted a memorandum in support of a motion to remand pursuant to Rule 23B of the Utah Rules of Appellate Procedure, which this court previously denied. Appellant has failed to demonstrate that this appeal presents any issue meriting further proceedings or consideration by this court. See Utah R. App. P. 10(a)(2).

Accordingly, we grant the sua sponte motion for summary disposition and affirm the order and judgment of the district court.
