The motion is signed by counsel for all parties. As grounds for the requested relief, the parties cite Texas Rule of Appellate Procedure 42.1(a)(2)(B). This rule authorizes an appellate court, in accordance with an agreement signed by the parties or their attorneys and filed with the clerk, to set aside the trial court s judgment without regard to the merits and remand the case to the trial court for rendition of judgment in accordance with the agreement. See TEX. R. APP. P. 42.1(a)(2)(B). The parties have complied with the requirements of Rule 42.1(a)(2)(B). Accordingly, we grant the parties' motion, vacate the trial court's January 17, 2012 judgment, without reference to the merits, and remand this case to the trial court for further proceedings consistent with the settlement agreement of the parties.
