TEXAS COURT OF APPEALS, THIRD DISTRICT, AT AUSTIN NO. 03-04-00374-CV Mark Pickett and Barbara Pickett, Appellants v. Texas Workers Compensation Insurance Fund, Appellee FROM THE DISTRICT COURT OF TRAVIS COUNTY, 345TH JUDICIAL DISTRICT NO. 99-15029, HONORABLE PATRICK O. KEEL, JUDGE PRESIDING MEMORANDUM OPINION Appellants have requested an abatement of this case based on counsel s health concerns. We abate the case until August 15, 2005. The case will be reinstated on August 15; appellants brief will be due September 14, 2005. Because an extension of time to file the brief has already been granted, and because of the length of the abatement, no further extensions will be granted. If appellants brief is not filed by September 14, 2005, the case will be dismissed for want of prosecution. See Tex. R. App. P. 42.3(b) (after ten days notice, court may dismiss for want of prosecution). W. Kenneth Law, Chief Justice Before Chief Justice Law, Justices B. A. Smith and Puryear Filed: April 27, 2005
