Reyes, Presiding July 15, 2016 MEMORANDUM OPINION WITHDRAWING PRIOR OPINION AND JUDGMENT AND RENDERING AGREED JUDGMENT Before QUINN, C.J., and CAMPBELL and PIRTLE, JJ. Appellant, University Medical Center Physician Network Services (PNS), and Appellee, Edward Leins, have filed a joint motion for rehearing requesting this court to set aside and modify its judgment to effectuate a settlement agreement pursuant to Rule 42.1(a)(2)(A) of the Texas Rules of Appellate Procedure. In particular, the parties ask this court to reverse the judgment of the trial court and render judgment that Leins take nothing. The parties have also requested this court to withdraw its opinion of May 2, 2016, stipulating that their agreement is not conditioned on the withdrawal of the court’s opinion. See TEX. R. APP. P. 42.1(c). Having considered the agreed motion of the parties, the relief requested is granted. Accordingly, we hereby set aside our previous judgment and render an agreed judgment reversing the judgment of the trial court and rendering judgment that Appellee, Edward Leins, take nothing. In light of this disposition, we also withdraw our opinion of May 2, 2016. Patrick A. Pirtle Justice 2
