COURT OF APPEALS SECOND DISTRICT OF TEXAS FORT WORTH NO. 02-17-00238-CV IN THE INTEREST OF D.H-B. AND D.H-B., CHILDREN ---------FROM THE 324TH DISTRICT COURT OF TARRANT COUNTY TRIAL COURT NO. 324-452255-09 ---------- MEMORANDUM OPINION1 ---------Appellant H.B. seeks to appeal a September 28, 2016 commitment order. On July 24, 2017, we notified H.B. of our concern that we lack jurisdiction over this appeal because the notice of appeal was due October 28, 2016, but was not filed until July 17, 2017. See Tex. R. App. P. 26.1. We informed H.B. that this appeal would be dismissed unless he or any party desiring to continue the appeal filed with the court, on or before August 3, 2017, a response showing grounds for continuing the appeal. See Tex. R. App. P. 42.3(a), 44.3. H.B. 1 See Tex. R. App. P. 47.4. supplemented his notice of appeal but did not file a response.2 Without a timely filed notice of appeal, this court lacks jurisdiction over the appeal. See Tex. R. App. P. 25.1(b). Accordingly, we dismiss this appeal for want of jurisdiction. PER CURIAM PANEL: MEIER, GABRIEL, and SUDDERTH, JJ. DELIVERED: August 31, 2017 Insofar as H.B.’s supplemental filing could be construed to constitute a response to our July 24, 2017 letter, it does not state grounds for continuing the appeal. 2 2
