In The Court of Appeals Ninth District of Texas at Beaumont _________________ NO. 09-11-00385-CR _________________ EX PARTE PAUL ANTHONY PARKS ________________________________________________________________________ On Appeal from the 1st District Court Jasper County, Texas Trial Cause No. 31585 ________________________________________________________________________ MEMORANDUM OPINION Paul Anthony Parks filed a notice of appeal of the trial court s order, in which the trial court denied his application for a writ of habeas corpus and ordered that Parks remain in the custody of the Jasper County, Texas, Sheriff without bail until he is transported to the State of Florida. On July 14, 2011, we denied appellant s motion to stay extradition. On July 21, 2011, the State filed a motion to dismiss the appeal as moot because Parks had been extradited to Florida and was no longer personally within the State of Texas. Parks did not file an objection to the motion to dismiss. 1 Appellant s extradition to the State of Florida renders his appeal moot. See Ex parte Stowell, 940 S.W.2d 242, 243 (Tex. App. San Antonio 1997, no pet.). Accordingly, we grant the motion to dismiss. We dismiss the appeal as moot.
