In The Court of Appeals Ninth District of Texas at Beaumont _________________ NO. 09-10-00379-CV _________________ IN RE MICHELLE JOHNSON _____________________________________________________________________ Original Proceeding _____________________________________________________________________ MEMORANDUM OPINION Michelle Johnson seeks mandamus relief from an order of the trial court that compels Johnson to sign a release for medical information other than mental health records, alcohol and drug abuse records, sexually transmitted disease information, and HIV/AIDS information. See TEX. R. CIV. P. 194.2(j). Johnson, the plaintiff in a personal injury suit arising out of a motor vehicle accident, argues that the trial court abused its discretion by ordering that Johnson authorize the release of medical records without regard to whether the records relate to past medical treatment of her head, neck, back, or seizure activity. Relator has not shown a clear abuse of discretion by the trial court. See In re Prudential Ins. Co. of Am., 148 S.W.3d 124, 135 (Tex. 2004). Accordingly, we deny the petition for writ of mandamus and request for temporary relief. 1 PETITION DENIED. PER CURIAM Opinion Delivered August 24, 2010 Before McKeithen, C.J., Gaultney and Kreger, JJ. 2
