In The Court of Appeals Ninth District of Texas at Beaumont ____________________ NO. 09-10-00026-CV ____________________ IN RE CHARLES ANTHONY WILLIAMS AND STATE COUNSEL FOR OFFENDERS __________________________________________________________________ __ Original Proceeding _____________________________________________________________________ MEMORANDUM OPINION Charles Anthony Williams and the Office of the State Counsel for Offenders (SCFO) filed a petition for writ of mandamus to compel the trial court to grant counsel s motion to withdraw, and to appoint non-SCFO counsel to represent Williams in his separate appeal from a sexually violent predator commitment order. See TEX. HEALTH & SAFETY CODE ANN. ยง 841.081 (Vernon Supp. 2009). Mandamus relief is an extraordinary remedy that issues only when a trial court clearly abuses its discretion and the relators have no adequate remedy by appeal. See In re Prudential Ins. Co. of Am., 148 S.W.3d 124, 135-36 (Tex. 2004). In this case, relators have not shown that they are entitled to mandamus relief. Accordingly, we deny the petition for writ of mandamus. 1 PETITION DENIED. PER CURIAM Submitted on January 29, 2010 Opinion Delivered February 25, 2010 Before Gaultney, Kreger, and Horton, JJ. 2
