PETITION FOR WRIT OF MANDAMUS DENIED

The court has considered relator's petition for a writ of mandamus and the response of the real party in interest and is of the opinion that mandamus relief should be denied. See Tex. R. App. P. 52.8(a). Accordingly, relator's petition for a writ of mandamus is denied. The stay imposed by this court's July 23, 2007 order is lifted.

1. This proceeding arises out of Cause No. 04-10-20392-MCV, styled Jorge A. Barboza-Sosa, M.D. and Gabriela Barboza v. Maverick Homes, Inc., pending in the 293rd Judicial District Court, Maverick County, Texas, the Honorable Cynthia L. Muniz presiding. However, the challenged order was signed by the Honorable Pat Priest, visiting judge.
