MEMORANDUM OPINION
No. 04-07-00193-CV
IN RE Marshal K. PONTHIER
Original Mandamus Proceeding (1)

PER CURIAM

Sitting: Alma L. L pez, Chief Justice

Sandee Bryan Marion, Justice

Steven C. Hilbig, Justice

Delivered and Filed: April 4, 2007

PETITION FOR WRIT OF MANDAMUS DISMISSED FOR LACK OF JURISDICTION

The court has considered relator's petition for writ of mandamus. This court has statutory authority to issue a writ of mandamus only: (1) when necessary to enforce this court's jurisdiction; and (2) against a judge of a district or county court within this court's district. See Tex. Gov't Code Ann. 22.221 (Vernon 2004). Because relator seeks mandamus relief against The Supreme Court of Texas Board of Disciplinary Appeals and has not shown that such relief is necessary to enforce this court's jurisdiction, relator's petition for writ of mandamus is dismissed for lack of jurisdiction. See id.; see also Tex. R. Disciplinary P. 7.11, reprinted in Tex. Gov't Code Ann., tit. 2, subtit. G app. A-1 (Vernon 2005) (providing appeal from a determination of the Board of Disciplinary Appeals to the Texas Supreme Court).

PER CURIAM

1. This proceeding arises out of BODA Case No. 39355, styled Marshal K. Ponthier v. David A. Woodard, decided by The Supreme Court of Texas Board of Disciplinary Appeals.
