PETITION FOR WRIT OF MANDAMUS DENIED

On November 30, 2006, Richard Hernandez, Jr. filed a pro se petition for a writ of mandamus , complaining of the trial court's failure to rule on a pro se pre-trial motion in the underlying criminal proceeding. Hernandez is represented by counsel in the trial court. A criminal defendant has no right to hybrid representation. Patrick v. State, 906 S.W.2d 481, 498 (Tex. Crim. App. 1995); Gray v. Shipley, 877 S.W.2d 806, 806 (Tex. App.--Houston [1st Dist.] 1994, orig. proceeding). Accordingly, we treat Hernandez's pro se petition as presenting nothing for this court's consideration. See Patrick, 906 S.W.2d at 498; Gray, 877 S.W.2d at 806. The petition for a writ of mandamus is denied.
