MEMORANDUM OPINION
No. 04-04-00757-CR
Richard Anthony RODRIGUEZ,
Appellant
v.
The STATE of Texas,
Appellee
From the 379th Judicial District Court, Bexar County, Texas
Trial Court No. 2001-CR-6956
Honorable Bert Richardson, Judge Presiding

PER CURIAM

Sitting: Karen Angelini, Justice

Sandee Bryan Marion, Justice

Phylis J. Speedlin, Justice

Delivered and Filed: December 15, 2004

DISMISSED FOR LACK OF JURISDICTION

The trial court imposed sentence on July 25, 2003. Because appellant did not timely file a motion for new trial, the notice of appeal was due to be filed August 25, 2003. Tex. R. App. P. 26.2(a)(1). A motion for extension of time to file the notice of appeal was due on September 9, 2003. Tex. R. App. P. 26.3. Appellant did not file his notice of appeal until October 20, 2004. Because it appeared that we did not have jurisdiction over this appeal, we ordered appellant to show cause in writing why this appeal should not be dismissed for lack of jurisdiction. Appellant failed to respond. We, therefore, dismiss this appeal for lack of jurisdiction.
