IN THE INTEREST OF J.C., et al., Children
From the 408th Judicial District Court, Bexar County, Texas
Trial Court No. 2003-PA-02079

PER CURIAM

DISMISSED FOR LACK OF JURISDICTION

Appellant seeks to appeal an order in a parental termination case that dismisses her counterclaims against the Texas Department of Family and Protective Services. This order does not dispose of the pending termination case, and no severance order appears in the record. An order that does not dispose of all parties and causes of action is not final and appealable. See Houston Health Clubs, Inc. v. First Court of Appeals, 722 S.W.2d 692, 693 (Tex. 1986); Northeast Indep. Sch. Dist. v. Aldridge, 400 S.W.2d 893, 895 (Tex. 1966).

On November 17, 2004, we ordered the appellant to show cause in writing why the appeal should not be dismissed for lack of jurisdiction. Appellant filed a response to our order; however, nothing contained in the response convinces this court that we should retain jurisdiction over this appeal. Accordingly, this appeal is dismissed for lack of jurisdiction. This dismissal is without prejudice to appellant's ability to appeal after a final judgment has been entered.
