DISMISSED FOR LACK OF JURISDICTION

On January 9, 2004, counsel for the appellee filed a letter informing this court that the trial court granted a motion nunc pro tunc on October 24, 2003 and no final order had been signed. Because the order appealed from did not appear final, we ordered the appellant, Debra Parker, to show cause why this appeal should not be dismissed. Appellant responded that she intends to appeal the decision made by the trial court on October 24, 2004, but no final order reflecting the judgment has been signed.

In the absence of a final judgment, we lack jurisdiction over the appeal. See City of Beaumont v. Guillory, 751 S.W.2d 491, 492 (Tex. 1988). Accordingly, this appeal is dismissed without prejudice for lack of jurisdiction. Costs of the appeal are adjudged against appellant.
