DISMISSED FOR LACK OF JURISDICTION
The trial court imposed or suspended sentence on January 6, 2003. Because appellant did not file a timely motion for new trial, the notice of appeal was due to be filed February 5, 2003. Tex. R. App. P. 26.2(a)(1). A motion for extension of time to file the notice of appeal was due on February 20, 2003. Tex. R. App. P. 26.3. Appellant filed notice of appeal on October 28, 2003. Appellant did not file a motion for extension of time.
On November 25, 2003, this court ordered appellant to show cause in writing why this appeal should not be dismissed for lack of jurisdiction. In response to our order, on December 4, 2003, appellant filed a response conceding that this appeal should be dismissed for lack of jurisdiction. Therefore, this appeal is dismissed for lack of jurisdiction.
