Richard Mauricio v. The State of Texas--Appeal from 379th Judicial District Court of Bexar County

Annotate this Case
MEMORANDUM OPINION
No. 04-03-00651-CR
Richard MAURICIO,
Appellant
v.
The STATE of Texas,
Appellee

From the 379th Judicial District Court, Bexar County, Texas
Trial Court No. 2003-CR-0809
Honorable Pat Priest, Judge Presiding (1)

PER CURIAM

Sitting: Sarah B. Duncan, Justice

Karen Angelini, Justice

Sandee Bryan Marion, Justice

Delivered and Filed: October 15, 2003

DISMISSED FOR LACK OF JURISDICTION

Richard Mauricio filed a notice of appeal stating he was "adjudged guilty" in the underlying criminal action. However, there is no judgment of conviction in this case. Rather, the trial court dismissed the action on motion of the State. As a general rule, we have jurisdiction of an appeal by a criminal defendant only after conviction. See Workman v. State, 170 Tex. Crim. 621, 622, 343 S.W.2d 446, 447 (1961). We do not have jurisdiction to review an order of dismissal. See Petty v. State, 800 S.W.2d 582, 583 (Tex. App.-Tyler 1990, no pet.). We therefore dismiss this appeal for lack of jurisdiction.
